Public Offer Agreement for the Purchase of Goods through the Website https://fitolavka.shop/

1. General Provisions

1.1. This Agreement is an offer by Sole Proprietor Dobryanska Taisiia Viacheslavivna (hereinafter referred to as the “Seller”) to any individual (hereinafter referred to as the “Buyer”) in accordance with Article 633 of the Civil Code of Ukraine.
1.2. Acceptance (confirmation) of the Agreement shall be made by placing an order on the Website.
1.3. The agreement regulates the rights and obligations of the parties, the procedure for payment, delivery and return of goods.

2. Subject of the Agreement

2.1. The Seller undertakes to transfer into the ownership of the Buyer the goods listed on the Website, and the Buyer undertakes to pay for and accept them.

2.2. Information about the goods (composition, price, characteristics) is posted on the Website and is part of the Agreement.

3. Ordering and Payment

3.1. The order is placed on the Website or by phone.
3.2. Payment is made in one of the following ways:

  • Online payment by credit card;
  • Payment systems;
  • Cash on delivery.

3.3. The price of goods is indicated on the Website in UAH, including VAT (if applicable).

4. Delivery of Goods

4.1. Delivery is carried out at the Buyer’s expense, unless otherwise agreed (except for promotional items).
4.2. The delivery time depends on the chosen method and is agreed upon when placing the order.
4.3. The risk of loss or damage to the goods passes to the Buyer after the delivery documents are signed.

5. Rights and obligations of the parties

5.1. The seller is obliged to:

  • Provide accurate information about the goods;
  • Fulfill the order within the established time frame;
  • Protect the Buyer’s personal data;
  • Accept the return of goods of inadequate quality.

5.2. The Buyer is obliged to:

  • Pay for the goods in a timely manner;
  • Accept the goods in proper condition;
  • Report any deficiencies found.

6. Responsibility of the parties

6.1. For violation of the terms of the Agreement, the parties shall be liable in accordance with the legislation of Ukraine.
6.2. The Seller shall not be liable for delayed delivery caused by actions of third parties or force majeure.

7. Dispute resolution

7.1. Disputes are resolved through negotiations.
7.2. If no agreement is reached, the dispute shall be referred to the court at the Seller’s place of registration.

8. Other conditions

6.1. The Agreement enters into force from the moment of acceptance by the Buyer.
6.2. All amendments and additions shall be made by publishing them on the Website.
